USCIS completes H-1B Cap Selection for FY 2022

United States Citizenship and Immigration Services (USCIS) has completed the randomized selection process for the fiscal year (FY) 2022 H-1B cap and master's cap lotteries. USCIS has notified all petitioners with selected registrations that they can begin to file H-1B petitions for those beneficiaries.
Employers who receive email notification that an action was taken on their case can log on to their myUSCIS account to view the selection notice(s) for each of their beneficiaries chosen in the FY 2022 H-1B lottery. Each selection notice includes information on where to file the beneficiary’s H-1B petition, and by what deadline. Employers must print the selection notice and include it in the petition for the associated beneficiary.
Employers will be able to view an updated status for every beneficiary on their myUSCIS account by March 31,2021. Statuses may include:
- Selected: The individual has been selected in the FY 2022 lottery. Employers have 90 days to file the beneficiary’s H-1B petition beginning April 1, 2021.
- Submitted: The beneficiary was not selected in the lottery, but the case remains open. USCIS will retain their petition in case it does not receive enough H-1B petitions to fill the FY 2022 cap.
- Not Selected: The individual was not selected in the lottery, and there are no additional spaces available for the FY 2022 cap. USCIS will not consider them again for this cap season.
- Denied: A duplicate registration was received for this individual, and so they are ineligible for the lottery.
- Invalidated: Failed Payment: The beneficiary is not eligible for the lottery because the registration payment method failed.
Employers may begin filing h-1b petitions starting april 1
Petitioners may begin to file H-1B cap-subject petitions for only those individuals selected in the FY 2022 lottery beginning April 1, 2021. Please contact your trusted Chugh, LLP attorney for help with filing.
