Summary

The US Citizenship and Immigration Services (USCIS) announced today that it has received enough H-1B cap registrations during the initial registration period of March 1 – March 20, 2020 to meet the cap. USCIS will notify petitioners and attorneys of selected registrations no later than March 31, 2020. Only petitioners with selected beneficiaries may file H-1B cap-subject petitions during the 90-day window for filing.

What to Expect

Petitioners and attorneys can now visit their online accounts to view the status of each registration, which will display one of the following:

• Submitted: A “Submitted” registration status will show until the initial selection process is complete. “Submitted” registrations will be considered for selection until the end of the fiscal year.
  • Registrations with a “Submitted” status should not file their cases until they are notified by USCIS.
• Selected: Registrations showing status as “Selected” means the registrant may file an FY 2021 H-1B cap-subject petition on or after April 1, 2020.
• Denied: Registrations showing a “Denied” status can mean that: (a) a duplicate registration was submitted by the same petitioner for the same beneficiary, or (b) a payment method was declined and not reconciled. Such registrations are deemed invalid.

USCIS will specify to which Service Center the petitioner is required to submit their selected H-1B cap petition.
