December 2023 Visa Bulletin: EB-2 and EB-3 China Advances Slightly and Remaining Employment-Based Categories Stay The Same

Introduction  

The United States State Department has released the December 2023 Visa Bulletin. A slight advance occurred in EB-2 and EB-3 for China. However, there was no change under the remaining Employment-Based categories. USCIS announced that it will honor the Dates for Filing chart in December.  

December 2023 Final Action Dates: 
 

  • EB-1: Priority workers. No Change. All countries are current with the exception of China which remains on February 15, 2022 and India remains on January 1, 2017.
  • EB-2: Advanced Degree Professionals. China advances by few weeks to October 22, 2019 and India remains on January 1, 2012. All other countries remain on July 15, 2022.
  • EB-3 Professionals and Skilled Workers: India remains on May 1, 2012 while China advances by few weeks to January 22, 2020. All other countries remain on December 1, 2021.
  • EB-3 Other Workers: No Change. India remains at May 1, 2012, China remains on January 1, 2016.
  • EB-4: No Change. All countries remain on January 1, 2019.
  • EB-4 for certain Religious workers is not yet authorized for issuance and unless extended is set to expire on November 17, 2023.
  • EB-5: Applies to Unreserved categories (C5, T5, I5, and R5), India remains on December 15, 2018 and China remains on October 1, 2015. Other countries will remain current. EB-5 set-aside categories such as Rural, High Unemployment, and Infrastructure will also remain current for all countries.

  • EB-1:  
    • China: August 1, 2022  
    • India: July 1, 2019  
    • All other countries: Current  

 

  • EB-2:  
    • China: January 1, 2020 
    • India: May 15, 2012  
    • All other countries: January 1, 2023  

 

  • EB-3 Professional and Skilled Workers:  
    • China: September 1, 2020
    • India: August 1, 2012 
    • Philippines: January 1, 2023
    • All other countries: February 1, 2023 

 

  • EB-3 Other Workers:  
    • China: June 1, 2017 
    • India: August 1, 2012 
    • Philippines: May 15, 2020
    • All other countries: December 15, 2020 

 

  • EB-4:  
    • All countries: March 1, 2019 

 

  • EB-5 Unreserved:  
    • China: January 1, 2017 
    • India: April 1, 2022
    • All other countries: Current 

 

  • EB-5 Set Aside:  
    • All Countries: Current
