On October 29, 2025, the Department of Homeland Security (DHS) announced an interim final rule (IFR) to end automatic extensions of Employment Authorization Documents (EADs) for most renewal applicants who file renewal of EAD on or after October 30, 2025.
Individuals currently on EAD should file their EAD renewals timely to avoid risk of losing work authorization. EAD extension can be filed 180 days before expiration.
Automatic extensions already in place before October 30, 2025 deadline are not affected.
DHS indicates that the IFR is meant to shift practice to more frequent case-case vetting to address fraud and national security concerns. Earlier, on December 13, 2024, a final rule provided for an automatic extension up to 540-days for certain applicants who fulfilled criteria; this change was done to prevent lapses due to processing delays. This new IFR would supersede that framework in the interim phase and later if published or adopted as a final rule.
Limited exceptions are made to this rule for EAD extensions provided by law or through Federal Register notice for Temporary Protected Status (TPS).
