January 2024 Visa Bulletin: EB-1 and EB-5 Categories for India Advance Significantly, Other Employment-Based Categories Advance Across Most Categories

Introduction

The United States State Department has released the January 2024 Visa Bulletin. There is a significant advance for India EB-1s and EB-5s. There is also movement across other employment-based categories.

Employment-based adjustment of status applications will be accepted based on the Dates for Filing chart as stated by USCIS.

January 2024 Final Action Dates: 

  • EB-1: Priority workers. All other countries are current with the exception of China which advances to July 01, 2022 and India which advances to September 01, 2020.
  • EB-2: Advanced Degree Professionals. China advances by two months to January 01, 2020 and India advances to March 01, 2012. All other countries advance to November 01, 2022.
  • EB-3 Professionals and Skilled Workers: India advances to June 1, 2012 while China advances by a few months to September 01, 2020. All other countries advance to August 01, 2022.
  • EB-3 Other Workers: India advances to June 1, 2012, China advances to January 1, 2017. Philippines remains at May 1, 2020. All other countries advance to September 01, 2020.
  • EB-4: All countries advance to May 15, 2019.
  • EB-5: Applies to Unreserved categories (C5, T5, I5, and R5), India advances to December 01, 2020 and China slightly advances to December 08, 2015. Other countries will remain current. EB-5 set-aside categories such as Rural, High Unemployment, and Infrastructure will also remain current for all countries.

  • China: June 1, 2020 
  • India: May 15, 2012  
  • All other countries: February 15, 2023

  • China: July 1, 2021
  • India: August 1, 2012 
  • Philippines: January 1, 2023
  • All other countries: February 1, 2023 
  • EB-3 Other Workers:  
  • China: June 1, 2017 
  • India: August 1, 2012 
  • Philippines: May 15, 2020
  • All other countries: December 15, 2020 
  • EB-4:  
  • All countries: September 1, 2019 
  • EB-5 Unreserved:  
  • China: January 1, 2017 
  • India: April 1, 2022
  • All other countries: Current 
  • EB-5 Set Aside:  
  • All Countries: Current
