On April 10, USCIS completed the random selection of H-1B cap petitions using a computer-generated process to meet the congressionally mandated H-1B quota for fiscal year (FY) 2020.
On April 5, USCIS announced it had received 201,011 H-1B petitions and enough petitions to meet the congressional mandate of 65,000 for regular cap and 20,000 for U.S. advanced degree exemption.
USCIS first counted all petitions (regular cap and advanced degree) towards the annual cap. Then they selected a sufficient number of the remaining eligible petitions to reach the advanced degree exemption.
All petitions that were not selected will be returned by USCIS with their filing fees unless the petition is a prohibited multiple filing.
