USCIS Reaches The Fiscal Year 2024 H-1B Cap

Introduction 

U.S. Citizenship and Immigration Services (USCIS) has reached the congressionally mandated number of petitions for the Fiscal Year 2024 H-1B Cap according to their recent announcement. Notices will be sent to registrants who were not selected through their online accounts in the upcoming days. The notification will be listed as “Not Selected – Not eligible to file an H-1B cap petition based on this registration”.

Petitions who are exempt from the cap will continue to be accepted and processed. Current H-1B workers who have been previously counted against the cap and who still retain their cap number are exempt from the FY 2024 H-1B cap. USCIS will continue to accept and process petitions filed to:

  • Extend the amount of time a current H-1B worker may remain in the United States;
  • Amend the terms and conditions of employment for H-1B workers;
  • Allow change of employers for current H-1B workers; and
  • Allow current H-1B workers to work parallel in additional H-1B positions.

 

The H-1B program is used by U.S. businesses to employ foreign workers in specialty occupations. H-1B petitioners are highly encouraged to subscribe to the H-1B cap season email updates in the H-1B Cap Season page.
