August 2022 Visa Bulletin: Most Cutoff Dates Remain Unchanged While EB-3 Moves Forward Slightly for China and India

The United States State Department August 2022 Visa Bulletin features limited forward movement for India and China in the EB-2 and EB-3 categories in the Final Action dates chart. The EB-1 visa is current for all countries. United States Citizenship and Immigration Services (USCIS) will accept adjustment of status applications using the Final Action Dates chart.

Final Action cutoff dates remain mostly unchanged in the August 2022 Visa Bulletin:

  • EB-1: Current for all countries, including China and India.
  • EB-2: China remains unchanged at April 1, 2019. India’s date remains at December 1, 2014. All other countries are current.
  • EB-3 Professionals and Skilled Workers: Dates advance one month for India to February 15, 2012, and one month for China to April 22, 2018.
  • EB-3 Other Workers: The worldwide cutoff date is unchanged at May 8, 2019. India advances one month to February 15, 2012, while China remains at June 1, 2012.
  • EB-5: Final Action dates are current for all countries except China, and for the “Set-Aside” categories. China’s Unreserved categories (C5, T5, I5, and R5) are unchanged at November 22, 2015.

adjusting status to lawful permanent resident

USCIS will use the Final Action Dates chart to accept applications for adjustment of status.

Individuals may adjust status to lawful permanent resident if their priority date is before the cutoff date listed for their preference category and nationality on the Final Action Dates chart.

    • India: January 1, 2015
    • China: May 1, 2019
    • Current for all other countries.
  • EB-3 Professionals and Skilled Workers:
    • India: February 22, 2012

  • EB-3 Other Workers:
    • India: February 22, 2012
    • China: August 1, 2015
    • Current for all other countries.
  • EB-4:
    • El Salvador, Guatemala, Honduras: December 8, 2017
    • Current for all other countries.
  • EB-5 Unreserved (Regional Center and Non-Regional Center):
    • China: December 22, 2015
    • Current for all other countries.
  • EB-5 Set-Asides:
    • Current for all countries in rural, high unemployment, and infrastructure categories
