Overview
The U.S. Department of State (DOS), in coordination with USCIS (U.S. Citizenship and Immigration Services), has announced that the annual limit for EB-2 India Immigrant visa category has been reached for the fiscal year (FY) 2026. As a result, U.S. embassies and consulates may not issue immigrant visas in the EB-2 preference category to India-chargeable applicants and EB-2 based adjustment of status applications filed with USCIS may not be approved until the government fiscal year resets on October 1, 2026.
Who Is Affected
USCIS will still accept EB-2 India adjustment of status filings that are current in the June Visa Bulletin. Applicants with scheduled adjustment of status interviews should still plan to attend their interviews but should be aware that the possibility remains for the agency to reschedule the AOS interviews given the unavailability of EB-2 India immigrant visa numbers until October. However, importantly, if an interview nevertheless still takes place, the adjustment of status case cannot be approved until an immigrant visa number becomes available at the start of the next government fiscal year on October 1, 2026.
