May 2023 VISA Bulletin: China Advances in EB-3; Retrogression may occur in EB-1, EB-2, and EB-5 for India in the upcoming months

INTRODUCTION

The May 2023 Visa Bulletin has been released by the U.S. State Department. China advances in the EB-3 and EB-5 categories. Adjustment of status applications will be accepted based on the Final Action Dates chart as stated by USCIS.

The State Department anticipates retrogressions in the EB-1 category for India and China in the upcoming months, and in the EB-2 and EB-5 categories for India, possibly in early June. 

May 2023 FINAL ACTION DATES:

• EB-1: China and India remain on February 1, 2022. All other countries remain current.
• EB-2: China remains on June 8, 2019, and India remains on January 01, 2011. All other countries retrogress to February 15, 2022.
• EB-3 Professional and Skilled Workers: China advances by five months to April 1, 2019. India remains on June 15, 2012. All other countries retrogress to June 1, 2022.
• EB-3 Other Workers: India’s cutoff date remains on June 15, 2012, and China advances to April 15, 2015. All other countries remain on January 1, 2020
• EB-4:  The final action date for all countries remains on September 1, 2018.
• EB-5 Non-Regional (C5, T5): For unreserved visas, the Final Action Date for China advances to September 8, 2015, and India remains on June 1, 2018. All other countries and categories remain current.
