United States Citizenship and Immigration Services (USCIS) has updated the USCIS Policy Manual to direct officers to defer to prior determinations when adjudicating extension requests that involve the same parties and facts. If there is a material error, material change, or new material fact in an extension request, the officer should consider the new information.
This policy change is in line with President Biden’s recent executive order, “Restoring Faith in Our Legal Immigration Systems and Strengthening Integration and Inclusion Efforts for New Americans”. The executive order instructs the secretary of homeland security to recognize barriers that obstruct access to immigration benefits and fair benefit adjudication.
