By Navdeep Meamber and Samapika Dash

Starting February 24, 2021, premium processing will be available for individuals requesting an extension of stay or a change of status to an E-3 visa using Form I-129, Petition for a Nonimmigrant Worker. Premium processing with United States Citizenship and Immigration Services (USCIS) allows petitioners to pay a fee to expedite the adjudication of certain forms, generally within 15 business days.

What is the E-3 Visa?

The E-3 visa is available to Australian nationals to perform a specialty occupation in the United States.  Australian nationals can apply for an E-3 visa directly through the Department of State if they are outside of the United States. If they are already present in the US, individuals can file for the visa by submitting Form I-129 with USCIS.

Individuals can qualify for the E-3 visa if they can demonstrate that they:

  • Are Australian nationals.
  • Have a valid employment offer in the US.
  • Hold the necessary qualifications to perform the duties of the offered position.
  • Will perform a specialty occupation.
