The September 2022 Visa Bulletin Advances Final Action Date for EB-5 China

The United States State Department has released the September 2022 Visa Bulletin. Overall, there is little to no movement in Final Action Dates and Dates for Filing. However, the Final Action Date for China will advance one month, to December 22, 2015, in the Unreserved EB-5 category.

The State Department has confirmed the FY 2022 employment-based visa limit is 281,507. USCIS will process as many adjustment of status applications as it can prior to the end of FY 2022, on September 30, and hopes to maximize use of the visa limit. Previously the employment-based preference limit was 262,288 and 156,253 in FY 2021 and FY 2022 respectively.

september 2022 final action dates:

  • EB-1: All countries remain current.
  • EB-2: China remains on April 1, 2019, and India remains on December 1, 2014. All other countries remain current.
  • EB-3 Professional and Skilled Workers: China remains on April 22, 2018, and India remains on February 15, 2012. All other countries remain current.
  • EB-3 Other Workers: The worldwide cutoff date is unchanged on May 8, 2019. Similarly, India remains on February 15, 2012, and China remains on June 1, 2012.
  • EB-4: The final action date for El Salvador, Guatemala, and Honduras remains on November 8, 2017. Mexico remains on April 1, 2020. All other countries remain current.
  • EB-5 Non-Regional (C5, T5): For unreserved visas, the Final Action Date for China advances one month to December 22, 2015. All other countries and categories are current.
